Terms of service

These are the terms that govern your use of Pelicart. They’re written in plain language so you can read them. Our privacy policy, POPIA & PAIA page and security guide sit alongside them.

1. Who you’re dealing with

Pelicart is not affiliated with Woolworths, Checkers, Pick n Pay, WhatsApp, or Meta. It works with your own store accounts, at your request. Pelicart is not a member of a self-regulatory or accreditation body. It follows no voluntary code of conduct or alternative dispute resolution code.

2. What Pelicart is (and is not)

Pelicart is a purchasing assistant on WhatsApp. You send a shopping list, and Pelicart builds a cart on your own Woolworths, Checkers Sixty60 or Pick n Pay account. If you link a store, Pelicart reads the order history on that account so it can pick the products you usually buy.

Pelicart does not check out, pick a delivery slot, or pay. When the cart is ready, you open the store’s app, review the cart, and complete the purchase there.

The store supplies your groceries. Delivery, substitutions, and refunds of groceries all run through the store, exactly as if you had placed the order yourself.

3. Agreeing to these terms

  • You agree to these terms by using Pelicart, whether you message it on WhatsApp or subscribe to Pelicart Pro. Pelicart links to them in the chat before you share your shopping details.
  • You must be 18 or older to use Pelicart. Carts can contain alcohol (see section 8).
  • One account per person, tied to your WhatsApp number.
  • Your store account has its own terms with Woolworths, Checkers or Pick n Pay. Those terms still bind you, and Pelicart doesn’t change them.

4. The service is AI-powered

When you message Pelicart, you’re talking to an artificial intelligence (AI) assistant, not a human. Human support is available on request.

AI assistants make mistakes. Pelicart can add the wrong item or the wrong size, prices are read at the moment the cart is built and can differ by the time you check out, and when your usual product is unavailable Pelicart may guess at a substitute you wouldn’t have picked.

That is why you must review your cart before you pay. Nothing is ordered until you check out in the store’s app, so the review step is your protection against AI mistakes. Please use it every time.

5. Free tier and Pelicart Pro

  • Free tier: your first 2 orders are free. That’s a lifetime total, not a monthly allowance.
  • Pelicart Pro: R99 per month for unlimited orders, billed through a hosted payment page. R99 is the full price: no VAT is added, and there are no other fees. You pay for one month at a time, with no minimum duration.
  • Cancelling: cancel anytime through the billing portal (say “unsubscribe” in the chat to get the link) or by asking Pelicart. No reason needed.
  • When the service starts: Pelicart replies on WhatsApp as soon as you message it. Pelicart Pro starts as soon as your payment goes through, and runs for one month at a time.

7-day refund: you can cancel Pelicart Pro within 7 days of subscribing and we refund that month’s fee, no reason needed. If the law gives you a cooling-off right, nothing here takes it away.

The groceries themselves have no cooling-off right. Grocery refunds run through the store under its own policy.

6. Payments and records

Your subscription card details go to the payment provider on its hosted page. Pelicart never sees your card number. It receives only subscription status. Grocery payments happen in the store’s app on your own store account. Pelicart is not part of that payment.

You can access a full record of your dealings with Pelicart:

  • Subscription invoices and receipts: in the billing portal, for as long as your Pelicart account exists. Ask about billing in the chat to get your portal link.
  • Orders: your order history lives in your store’s app, exactly like any other order you place there.
  • Your personal data: request a copy following the privacy policy.

7. Acceptable use

Use Pelicart lawfully and for your own grocery shopping. In particular:

  • don’t try to access anyone else’s data, account, or store login
  • don’t probe, overload, or disrupt the service or try to work around its limits
  • don’t use Pelicart to abuse or defraud the stores, their staff, or their systems

We may suspend or terminate an account that breaks these rules, with notice where that’s reasonable.

8. Alcohol and age-restricted items

If you ask for wine, beer, or another age-restricted item, it can end up in your cart like any other product. The store performs age verification at checkout and delivery under its own rules. Pelicart does not sell alcohol and cannot complete a purchase. You must be 18 or older to use Pelicart at all (section 3).

9. Availability and changes

Pelicart is run on a best-effort basis. It depends on WhatsApp and Meta, on the stores’ own systems, and on other providers. When any of those are down or change, Pelicart can be slow, limited, or unavailable. We don’t promise uninterrupted service.

Features may change or be withdrawn as the product develops. If we ever discontinue Pelicart, we’ll give reasonable notice. We will never start charging you, or charge you more, without telling you first.

10. Limitation of liability

Please read this section carefully.

Nothing in these terms excludes or limits Pelicart’s liability for gross negligence or wilful misconduct, for fraud, for liability under section 61 of the Consumer Protection Act where it applies, or for anything else the law does not allow us to exclude. Nothing in these terms takes away rights you have under the Consumer Protection Act, POPIA or ECTA.

The store supplies your groceries. The quality, safety, delivery and refunds of the goods are between you and the store, exactly as if you had placed the order yourself. Pelicart acts as your agent to build the cart. It is not the seller of the groceries.

The law can permit Pelicart to exclude indirect or consequential loss. This can include a missed delivery in a cart you did not review. It can also include store substitutions, store price changes, or provider downtime. For direct loss from our ordinary negligence, a total liability cap applies. The cap is the greater of two amounts. The first amount is what you paid Pelicart in the three months before the claim. The second amount is one month’s Pelicart Pro subscription fee.

You approve the cart and pay in the store’s app. Section 4 explains why that review step is your protection against mistakes.

11. Privacy

How Pelicart collects, uses, shares, and deletes your personal information is set out in the privacy policy, which is Pelicart’s notice under the Protection of Personal Information Act (POPIA). The POPIA & PAIA page explains your access-to-information rights and how to exercise them.

12. Governing law, changes, and contact

  • Governing law and forums: South African law governs these terms, and South African courts have jurisdiction. Your statutory forums stay open regardless: the National Consumer Commission for Consumer Protection Act complaints, and the Information Regulator for privacy complaints (contact details in the privacy policy).
  • Severability: if any part of these terms turns out to be invalid, the rest still applies.
  • No waiver: if we don’t enforce a term at some point, we can still enforce it later.
  • Assignment: we may transfer these terms to a successor of the Pelicart business; you may not transfer your account or these terms without our written consent.
  • Entire agreement: these terms and linked pages form the whole agreement between you and Pelicart. They do not limit rights that the law gives you.
  • Changes to these terms: we may update these terms as the product and the law change. For material changes we’ll give notice on WhatsApp or on this website before they take effect, and the date at the top always shows the current version.
